In May 2018 the updater v6.9.2 introduced an inline terms and conditions popup. https://www.ecommercetemplates.com/support/topic.asp?TOPIC_ID=110012
An Inline Terms and Conditions page can be created by simply creating a Content Region with the region name of "termsandconditions". As all the other cart features have moved to inline popups this now gives the terms and conditions the same look and feel as the rest of the site.
If you need to make your customers agree to your terms and conditions on checkout, set $termsandconditions=TRUE; You will also need to create a page with your terms and conditions called termsandconditions.php ... which will be shown in a 420 x 380 popup.

Remember - Any edits to the ectcart.css file will be overwritten by updater's. ALL edits to ectcart.css rules should be placed in your style.css file
